These terms set out the conditions for using the iPhone app Odd Spot (the “App”). By using the App you are taken to have agreed to them.
1. Price
The App is free. There are no in-app purchases. It shows advertising so that it can stay free.
2. What you may do
You may use the App freely for personal purposes. There is no limit on how often or how long.
3. What we ask you not to do
- Modify the App, or reverse-engineer it and redistribute it
- Block the App’s advertising, or inflate ad impressions by improper means
- Use the App for any purpose that breaks the law
4. Your records
Scores and other records are stored only on your device. Changing phones, deleting the App or resetting the device will lose them, and there is no way to restore them. No backup feature is provided.
5. Not a medical test
The App is a game about telling colors apart. It does not test or diagnose color vision. The numbers it shows change with the screen you use, the light around you and how you feel that day. Please do not use them as a basis for any medical judgement. If you have concerns about how you see color, please consult an ophthalmologist.
6. Disclaimer
The App is provided as is. The developer does not warrant that it will always work correctly or that it is fit for any particular purpose.
The developer is not liable for damage arising from use of the App, except where the damage is caused by the developer’s intent or gross negligence.
Advertising shown in the App is supplied by Google and by advertisers, and the developer is not responsible for its content. Please direct questions about an ad to the advertiser or to Google.
7. Ending the service
The developer may stop providing the App without prior notice.
8. Changes to these terms
These terms may be revised as needed. For a significant change, the date at the top of this page will be updated.
9. Governing law
These terms are governed by the law of Japan. Any dispute relating to the App shall be submitted to the exclusive jurisdiction of the Japanese court having jurisdiction over the developer’s address.
If you use the App as a consumer, this does not remove the protection of any mandatory law of your country of residence.
